Terms of Use — THE FRYM

Thefrym.art (the "Site") is operated by the FRYM ("we," "us," "our"). By accessing this Site and The FRYM Shop (thefrym.square.site/s/shop), purchasing artwork, commissioning work, or purchasing items from The FRYM Shop, you agree to the following terms.
1. Intellectual Property
All artwork, images, photographs, text, and content on this Site are the intellectual property of The FRYM and are protected by copyright law. This includes original paintings, prints, items from The FRYM Shop, and any documentation of live performances or brand collaborations.
1.1 You may not reproduce, distribute, publicly display, or create derivative works from any content on this Site and The FRYM Shop without prior written permission.
1.2 Purchasing an original artwork or print transfers ownership of the physical object only. It does not transfer copyright, reproduction rights, or the right to create derivative works. The FRYM retains all copyright unless otherwise agreed in writing.
1.3 Commissioned artworks remain subject to the same copyright terms unless a separate licensing agreement has been made.
1.4 In the UK, copyright protection is automatic as soon as an original work is created and fixed in a tangible medium of expression (e.g. a painting or sculpture) — no registration is required for this protection to apply.
1.5 UK law allows limited use of copyrighted work without permission under "fair dealing," for purposes such as criticism, review, news reporting, teaching, and research. For example, a low-resolution image of an artwork used within a review may qualify as fair dealing.
2. Purchasing Original Artwork
2.1 Original artworks are handmade using egg tempera, natural pigments, and acrylics, and each piece is unique. Minor variations in texture, tone, and surface are inherent to the medium and are not considered defects.
2.2 Prices are listed on the Site or provided by quote and are subject to change without notice until an order is confirmed.
2.3 All original artwork sales are final except where the piece arrives significantly damaged. See our Returns Policy below.
3. Prints
3.1 Prints are giclée, produced on demand, on paper or canvas, up to the size of the original artwork.
3.2 Because prints are made to order, they are non-returnable except in cases of damage or printing error. Please inspect prints promptly upon arrival and report any issues within 14 days.

4. Commissions
4.1 Commissions are created exclusively within The FRYM's distinctive artistic style. The practice does not accept requests to work outside of it.
4.2 The commission process begins with a pencil sketch to approve the composition, followed by production of the final piece.
4.3 Payment is required in stages before work begins and before delivery. Two payment structures are available:
Three-part split: 25% prior to the pencil sketch, 25% on approval of the sketch, 50% on completion.
Two-part split: 50% prior to the start of work, 50% on completion (prior to delivery).
4.4 No commissioned artwork will be shipped until payment has been received in full.
4.5 Estimated turnaround is typically 4–8 weeks, though this may be extended if the artist is engaged in a residency programme or touring exhibition. Estimated timelines and quotes are provided within 48 hours of enquiry.
4.6 Once work has begun (i.e. after the first payment is made), commissions are non-refundable, given their bespoke nature.
5. Shipping
5.1 Worldwide shipping is available. Artworks are shipped either flat-packed or rolled in a protective tube, depending on size and medium.
5.2 Shipping in a tube is generally the safer and more affordable option; original artworks may be shipped off their stretcher bars, together with the frame, for restretching by a local framing service on arrival.
5.3 Flat-pack shipping is used for smaller artworks or pieces not suited to rolling.
5.4 Shipping costs and estimated delivery times are quoted individually based on the shipment details provided with a Purchase Request.
5.5 Risk of loss or damage in transit is discussed on a case-by-case basis. Please contact to confirm insurance options before shipment.
6. Returns & Refunds
6.1 Original artworks are returnable only if they arrive significantly damaged. Please contact with photographs of the artwork and packaging within 14 days of delivery.
6.2 Gift shop items may be returned within 14 days of delivery, provided the item is unused and in its original packaging. Return shipping is the buyer's responsibility unless the artwork arrived faulty.
6.3 Prints are made to order and non-returnable, except in cases of damage or printing error.
6.4 Commissions are non-refundable once work has begun unless they arrive significantly damaged.
7. Brand Collaborations & Private Hire
7.1 Brand collaborations, live painting performances, and event bookings are arranged through The FRYM's representing artist-led experience agency at marina@amou.live.
7.2 Terms for brand collaborations, licensing, and event bookings (including deposits, cancellation policies, and usage rights) are agreed separately in writing for each engagement and are not governed by these general Terms of Use
8. Website Use
8.1 You agree to use this Site only for lawful purposes and not to attempt to interfere with its operation or security.
8.2 The owner of the Site makes reasonable efforts to ensure information on the Site is accurate but do not guarantee that descriptions, images, or availability are error-free at all times.
9. Limitation of Liability
To the fullest extent permitted by law, The FRYM is not liable for indirect, incidental, or consequential damages arising from the use of this Site or the purchase of artwork, beyond the value of the item purchased.
10. Changes to These Terms
The Site owner may update these Terms of Use from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised terms.
